Terms of Service

The deal between you and Radius.

This is the contract between you and Radius Family LLC for using Radius. We kept it short. When it talks about what the app does, it matches what the app really does, with the same numbers as the acknowledgment you sign and the privacy policy. You agree to it with a checkbox when you create your account, and the exact words of the version you agreed to are kept.

The short version

  • You need to be 18 or older to create your own account. Anyone younger joins when an adult on their family plan sets them up, and a child under 13 also needs verifiable parental consent.
  • Only share the location of people who know. Tracking someone without their knowledge breaks these terms, and we'll close accounts for it.
  • A family plan is $2.99 a month through your app store, after a free 30-day trial. You can cancel any time, and we'll tell you at least 30 days before any price change.
  • The messages, photos, videos and documents you send belong to you. We only use them to run the service.
  • Location can be wrong or late. Crash detection can miss a real crash, and it's never a substitute for calling 911.
  • If we disagree, talk to us first at help@radiusfamily.com. A person answers.

This summary is here to help. It isn't part of the Terms of Service. The full text below is what counts.

1 · Who this is with

Radius is operated by Radius Family LLC, a Wisconsin limited liability company. "We" and "us" mean that company. "You" means the person using the app or the website.

2 · Accepting these terms

You accept these terms by ticking "I agree to the Terms of Service" when you create an account, and that tick is recorded — the date, the version, and the account that gave it. If we change the terms in a way that matters, the app will say so before the change takes effect, and continuing to use Radius after that date is acceptance of the new version. Every version is dated and kept, so what you agreed to can always be read back, word for word.

3 · Who may use it

You must be 18 or older to create a Radius account for yourself. Radius is a general-audience service for families and friends; it is not directed to children. A person under 18 joins only when an adult on their family plan sets them up and agrees on their behalf. For a child under 13 that adult must additionally complete verifiable parental consent, because federal law (COPPA) requires it before any personal information — including location — may be collected. How that works is at radiusfamily.com/childrens-privacy. The adult who consents may withdraw at any time, and withdrawing stops the collecting immediately.

4 · Your account

Keep your sign-in details to yourself; everything done from your account is yours to answer for. Tell us if you think somebody else has got into it. Give true information when the app asks for it — a made-up birthday for a child, in particular, defeats protections that exist for that child.

5 · Acceptable use

Only share the location of people who know. Radius shows a permanent notification while it is sharing, and nobody is added without approval, precisely so that it cannot be used to follow somebody secretly. Using it to track a person without their knowledge — a partner, an employee, anyone — is a violation of these terms and, in most places, of the law. We will close accounts for it. Do not use Radius to break the law, to harass anybody, or to try to break the service itself. The full rules, including how to report someone, are at radiusfamily.com/acceptable-use and are part of these terms.

6 · Paying

Radius costs $2.99 a month for a family plan, billed through the app store you installed from, after a free 30-day trial. Prices are on the pricing page and are what you pay unless we tell you otherwise in advance. Subscriptions renew automatically until cancelled. You can cancel any time, from Settings or from your app store account, and you keep what you paid for until the end of the period you paid for. If a subscription was bought through Apple or Google, cancelling and refunds are handled by them under their rules, not ours. We can change the price; if we do, we will say so at least 30 days beforehand, and the new price applies from your next renewal — never retroactively.

7 · Your content stays yours

The messages, photos, videos and documents you send belong to you. You give us only the licence needed to run the service: to store them for the retention period, to deliver them to the people you sent them to, and nothing else. We do not read them to build profiles, use them to train anything, or show them to anybody you did not send them to. Delete your account and they are deleted with it.

8 · What is ours

The Radius apps, the website, the name and the mark are Radius Family LLC’s. The app is licensed to you, not sold — the licence, including the app-store terms it carries, is at radiusfamily.com/eula. Map imagery belongs to its providers, and the map data drawn over it is © OpenStreetMap contributors, used under the Open Database License.

9 · What Radius does not promise

Radius is a convenience, not a safety system, and the difference matters. Location can be wrong or late: it comes from a phone — usually accurate to a few metres outdoors, sometimes a street off indoors or in cities, and minutes behind when a phone is asleep, out of signal, or out of battery. Crash detection can miss a real crash, and can raise one that never happened: it reads the phone’s motion sensors and its GPS, and a phone is not bolted to a car. It needs battery, signal and location to work at all, and it delays itself by its own countdown by design. It is never a substitute for calling 911 — if you can call for help, call for help. Speeding and hard braking are conversation starters, not evidence: GPS speed is approximate, and posted limits come from community map data that is sometimes missing or out of date. They must not be used for discipline based on a single reading, for insurance, or for legal purposes. Weather alerts come from the National Weather Service and can arrive late or not at all; they are never a substitute for official warnings, sirens, or your own judgment. Radius is provided "as is". We do not promise it will be uninterrupted or error-free, and we do not promise any particular accuracy.

10 · Limits on what we owe you

To the fullest extent the law allows, Radius Family LLC is not liable for indirect, incidental or consequential damages, or for anything arising from a location that was wrong or late, an alert that did not arrive, or a crash that was not detected. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the previous twelve months or $50. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit. Some places do not allow these exclusions, in which case they do not apply to you.

11 · If your misuse causes claims

If you use Radius in a way these terms forbid — tracking somebody without their knowledge is the obvious one — and somebody brings a claim against us because of it, you agree to cover the costs and damages that claim causes us. This is about misuse; it does not apply to ordinary use of the app as described.

12 · Maps and other people’s services

Radius includes Google Maps features and content. By using Radius you agree that your use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service (at maps.google.com/help/terms_maps) and the Google Privacy Policy (at policies.google.com/privacy). On iPhone and iPad the map is drawn by Apple’s MapKit and is subject to Apple’s terms. The map picture is theirs; the things drawn on it are ours: where your family is, the routes between them, and the roads’ posted speed limits, all computed on Radius’s servers from OpenStreetMap data. We do not send your family’s location to a mapping company to be routed or looked up. Payments are handled by the app stores; notifications are delivered by Google’s messaging service. Each is governed by its own terms.

13 · Your data, and ending things

What we collect, how long we keep it and who can see it is in the privacy policy at radiusfamily.com/privacy, which is part of these terms. The short version: positions are kept 10 days, messages 14 days, and nothing about you is sold, given to a data broker, or used to decide what to advertise to you — Radius carries no advertising at all. You can delete your account at any time from Settings or from the web, which removes your messages, photos, history, places, groups and connections. We may suspend or close an account that breaks these terms, and will say why unless we are not allowed to. Signed consent records are kept after deletion, because the law that required them requires keeping them; they are records of an agreement, not of where anybody was.

14 · If we disagree

Talk to us first: help@radiusfamily.com, and a person answers. Most problems are a refund, a fix, or an explanation, and none of those needs a courtroom. Failing that, these terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules, and the courts of Wisconsin have jurisdiction — except where the law of the place you live gives you the right to bring a claim somewhere else, which these terms do not take away.

15 · Reaching a person
